Divorce & Post Divorce Mediation

What is Divorce Mediation?

Divorce Mediation is a non-adversarial process in which a neutral third-party professional guides couples in addressing all issues associated with divorce.  Couples should have full control over decisions impacting their lives and the lives of their children.  A skilled mediator fosters a collaborative environment in which couples engage directly to establish a comprehensive divorce settlement agreement (or a post-judgment modification agreement) that is just, equitable, and honored by both parties.

What is the role of the mediator?

  • The mediator gathers and systematically reviews the necessary documents with each couple.

  • The mediator proposes viable alternatives when there is disagreement.

  • The mediator provides information about the legal system.

  • The mediator drafts the couple's comprehensive separation agreement (or post-judgment modification agreement) and the required court forms for submission by the parties to the court for final approval.

What are the benefits of divorce mediation versus conventional litigated divorce?

  • The mediation process fosters mutual respect, informed decision-making, active involvement, and a genuine concentration on the present and future.

  • Divorcing couples are more likely to abide by the terms of an agreement they've created through mediation than to a court order imposed by a judge after a lengthy and contentious hearing.

  • Mediation is less expensive than hiring an attorney to represent you in court.

  • Your divorce (or post-judgment matter) can be finalized soon after your agreement is filed with the court versus waiting several months for a trial date.
